In a private agency adoption in Texas, a birth parent may relinquish his or her parental rights to the adoption agency by executing a affidavit of relinquishment of parental rights at least 48 hours after the birth of the child. In the relinquishment, the birth parent consents to the agency being appointed as the managing conservator of the child with the authority to place the child with a prospective adoptive parent that either the birth parent or the agency chooses.
